1. Who you are buying from
This site is operated by Mosse Pearl Jewelry, a business registered in Malaysia under registration number 202603199388, of Setia City Residences 6, B13-3, Jalan Setia Dagang AH U13/AH, Setia Alam, 40170 Shah Alam, Selangor, Malaysia. Contact details are on the contact page.
2. What these terms cover
They apply to every order placed through this website. Placing an order means you accept them. If you do not, please do not order — and if something in them is unclear, ask first; we would rather explain than argue later.
You must be at least 18, or have the consent of a parent or guardian, to place an order.
3. How an order is formed
Adding a piece to your bag is not an order, and our product pages are an invitation to buy rather than a binding offer. A contract forms only when we send you an order confirmation.
We may decline an order — and refund you in full — where the piece has sold, where a price or description was clearly wrong, where we cannot deliver to your address, or where we suspect fraud. Stock is small and largely one-of-a-kind, so two people can want the same strand within minutes of each other.
4. Prices and payment
- All prices are shown in Malaysian Ringgit (RM) and include any applicable tax.
- Delivery is charged separately unless stated otherwise, and is shown before you confirm.
- Payment is taken in full at checkout through a licensed payment provider. We do not see or store your card details.
- Prices can change, but never after your order is confirmed. The price you were charged is the price.
If a piece is listed at an obviously incorrect price — a decimal in the wrong place — we will contact you before doing anything, and you may confirm at the correct price or cancel for a full refund.
5. The pieces themselves
Pearls are grown by an animal, not manufactured to a tolerance. Size, shape, overtone and surface vary between individual pearls, and the piece you receive will differ slightly from the photograph. That is the material, not a defect.
Screens also differ. Colour on your monitor or phone is an approximation, and warm ivory can read cooler or pinker depending on the display.
The grading published on each product page describes that piece to the best of our knowledge. Where we say a pearl is a given size, that is a measured range, not a guarantee that every pearl in a strand is identical.
6. Delivery
We deliver within Malaysia, and elsewhere by arrangement — write to us before ordering from abroad. Orders are dispatched insured, and we will send tracking when the piece leaves us.
Delivery estimates are estimates. Risk in a piece passes to you on delivery. If a parcel does not arrive within a reasonable time, tell us and we will chase the courier — do not wait quietly.
Customs duties or import taxes on an international order are yours to pay, and are not included in the price.
7. Returns, faults and refunds
Set out in full in the returns and refunds policy, which forms part of these terms. In short: fourteen days to change your mind on an unworn piece, and a separate, unlimited-by-time right where something is faulty or not as described.
Nothing in these terms limits your rights under the Consumer Protection Act 1999 or the Sale of Goods Act 1957. Where these terms and those Acts disagree, those Acts win.
8. Care of what you buy
Nacre is soft and reacts to acid. Perfume, hairspray, cosmetics, chlorine, solvents and ultrasonic cleaners all damage it, and that damage is not a manufacturing fault. Care guidance is published on the Our Pearls page and included with every piece.
9. This website
The text, photography, wordmark and design of this site belong to Mosse Pearl Jewelry. You are welcome to share links to it. You may not copy our product photography or descriptions for commercial use without written permission.
We try to keep the site accurate and available, but we do not promise it will be uninterrupted or error-free.
10. Our liability
We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, or for business losses — this shop sells to individuals.
Nothing here excludes liability we cannot lawfully exclude, including for death or personal injury caused by negligence, or for fraud.
11. Events outside our control
We are not liable for delay or failure caused by something genuinely beyond our control — courier failure, natural disaster, civil disturbance. If such an event affects your order we will tell you, and you may cancel for a full refund if the delay becomes unreasonable.
12. Privacy
How we handle personal data is set out in the privacy policy, written under the Personal Data Protection Act 2010.
13. Changes to these terms
We may update these terms. The version that applies to your order is the version published when you placed it, not a later one. The date at the top tells you which that is.
14. Governing law
These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute arising from them.
15. Complaints
Write to us first — most things are a misunderstanding that one email resolves. If we cannot settle it between us, you may take a claim to the Tribunal for Consumer Claims Malaysia, which handles consumer disputes without lawyers and at low cost.
